1. Definitions
In these Terms:
- "We", "us", "our", "Expats Thailand" means Naskio Limited, operating the website expats-thailand.com.
- "You" means any person who accesses the Site, submits a request through it, subscribes to our newsletter, or engages one of our services.
- "Site" means expats-thailand.com and all its pages and subpages.
- "Partner" means an independent third-party business or professional we may introduce you to, such as an insurance provider, housing agency, visa specialist, lawyer, accountant, bank, school, or vehicle rental company.
- "Our Services" means services delivered directly by us, as opposed to services delivered by a Partner.
- "Partner Services" means services delivered by a Partner, whether or not we made the introduction.
2. Who we are
Expats Thailand is operated by Naskio Limited, a company incorporated in Hong Kong under Certificate of Incorporation No. 80333049, holding Business Registration No. 80333049-000-05-26-8, with its registered office at Unit B, 11/F, Yam Tze Commercial Building, 23 Thomson Road, Wan Chai, Hong Kong.
We publish editorial content about relocating to and living in Thailand, and we operate a concierge service that helps people organise their move and their day-to-day administrative life once they arrive.
3. Acceptance of these Terms
By accessing the Site, submitting a form, sending us a message, subscribing to our newsletter, or engaging any of Our Services, you confirm that you have read, understood and accepted these Terms. If you do not accept them, please do not use the Site or our services.
If you are using the Site or requesting a service on behalf of someone else (a spouse, a child, an employee, or a company), you confirm that you have the authority to do so and to share their information with us.
4. What we do, and what we do not do
What we do. We help people who are moving to Thailand, or already living there, deal with the practical side of that move. In practice this takes two forms.
First, we publish free editorial content: guides on visas, cost of living, cities, schools, healthcare, banking, taxation, driving, and daily administrative obligations such as TM30 filings and 90-day reports.
Second, we operate a concierge service. For most requests, our role is that of an introducer and coordinator: we take the time to understand your situation, we tell you honestly which options are realistic, we recommend and introduce you to an independent Partner suited to your case, and we stay available to help the process move along. For a small number of services, described as such on the relevant service page, we carry out the work ourselves.
What we do not do. We are not a law firm, an immigration agency, an accounting firm, a licensed insurance broker, a licensed real estate agency, a bank, or a financial adviser. We do not hold any professional licence in Thailand or elsewhere that would allow us to provide regulated advice.
Nothing on the Site and nothing said to you by a member of our team constitutes legal, immigration, tax, financial, medical or investment advice. Our editorial content and our recommendations are general information intended to help you make an informed decision and ask the right questions. They are not a substitute for advice from a licensed professional and should not be relied upon as such. Where your situation calls for regulated advice, we will tell you so and point you toward an appropriate professional.
5. Our role in relation to Partners
Partners are independent businesses. They are not our employees, agents, subsidiaries or franchisees, and we do not control how they operate.
When you engage a Partner, the work takes place under their own agreement with you: their terms, pricing, timelines, insurance, professional obligations and complaint procedures are the ones that apply. In practice, this means we stay alongside you to keep things moving and to help if something gets stuck, but we are not a party to that agreement and we cannot commit on a Partner's behalf to how their work is carried out.
We select Partners with care. We check that they are properly established, we deal with them directly, and we take client feedback seriously: if a Partner stops meeting our standards, we stop referring people to them. But due diligence is not a guarantee, and we ask you to carry out your own checks and to read any contract before you sign it, particularly for significant commitments such as a lease, an insurance policy, a company formation or a vehicle purchase.
6. How a request normally works
A typical request follows these steps. We describe them so you know what to expect, not as a contractual commitment to a fixed process or timeline.
- You contact us through a form on the Site, by email, or by messaging app, describing what you need.
- We come back to you with questions to understand your situation properly: your timeline, your budget, your family situation, your visa status, and anything else relevant.
- We tell you what we think is realistic, including when the answer is that what you want is not achievable, or not achievable in the way you had in mind.
- Where a Partner is involved, we introduce you and share the information needed for them to respond properly. Where Our Services apply, we confirm the scope and the price in writing before starting.
- We stay reachable while the process runs, and we follow up if things stall.
7. Fees, payment and currency
Our editorial content, our initial assessment of your situation, and our introductions to Partners are free of charge to you.
Where Our Services are chargeable, the price is set out on the relevant service page and confirmed to you in writing before any work begins. No charge is ever applied without your prior agreement.
Partner Services are billed to you directly by the Partner, under their own pricing and payment terms. Those terms will be disclosed to you before you commit. We do not collect payment on a Partner's behalf, and we are not responsible for a Partner's invoicing, refunds or payment processing.
Prices shown on the Site are indicative and may change without notice, in particular where they depend on a Partner's own pricing, on government fees, or on exchange rates. Where a price is shown in a currency other than the one you will be billed in, that conversion is indicative only and we do not guarantee any exchange rate. Bank charges, card fees and currency conversion costs applied by your own bank are yours to bear.
8. Cancellation and refunds
For Our Services, you may cancel at any time before work begins and receive a full refund of anything already paid.
Once work has begun, we will refund any portion of the fee corresponding to work not yet carried out, assessed reasonably and in good faith. Where a service has been substantially delivered, no refund is due, including where the outcome is not the one you hoped for, since we charge for the work, not for a result (see Section 9).
Where a third party's fee has already been paid on your behalf or is non-refundable to us (a government fee, an application fee, a deposit), that amount cannot be refunded.
For Partner Services, cancellation and refunds are governed entirely by the Partner's own terms. We will help you raise the matter with them, but we cannot refund money we never received.
9. No guarantee of outcome
We are careful about what we promise, and we would rather tell you something is unlikely than sell you false hope.
We cannot and do not guarantee any particular outcome. This includes, without limitation: the grant, renewal or extension of any visa or permit; approval of a bank account, loan, credit facility or card; an insurer's underwriting decision or the pricing of a policy; admission to a school; the availability of a specific property, vehicle, appointment slot or service; the processing time of any application; or the decision of any government department, embassy, consulate or immigration office.
Decisions on all of these matters rest with the relevant third party, under rules that can change without notice and that are frequently applied differently from one office, province or officer to another. Our fee, where one applies, is payable for the work we carry out and the guidance we provide, not for a specific result.
10. Accuracy of information on the Site
Thai administrative rules, particularly around visas, immigration reporting, taxation and insurance requirements, change often, are sometimes announced with little notice, and are frequently applied inconsistently between offices. We review our content regularly and correct it when we learn it is out of date, but we cannot guarantee that every page is accurate and current at the moment you read it.
Before acting on anything you read here, and particularly before making a financial commitment or a travel booking that depends on it, verify the position with the relevant authority or with a licensed professional. If you spot something on the Site that looks wrong or out of date, please tell us at contact@expats-thailand.com: we would rather hear it from you than leave it there.
11. Information you give us
You confirm that the information you give us is accurate and complete, and that you will tell us if it changes materially while we are helping you.
This matters more than it might seem. Recommendations on visas, insurance and banking depend directly on details such as your nationality, your age, your income, your visa history, your health and your family situation. Incomplete or inaccurate information can lead to a recommendation that does not suit your case, an application that is refused, or an insurance policy that does not cover you when you need it. We are not responsible for consequences arising from information you gave us that was inaccurate or incomplete.
12. Links to other sites
The Site contains links to Partner websites, government pages and other third-party resources. We provide them for convenience. We do not control those sites, we are not responsible for their content, their accuracy or their privacy practices, and a link does not imply endorsement of everything that site contains.
13. Newsletter and communications
If you subscribe to our newsletter, we will send you periodic updates about living in Thailand and about our services. You can unsubscribe at any time using the link in any email, or by writing to contact@expats-thailand.com.
Where you have contacted us about a specific request, we may also contact you about that request and follow up on it. That correspondence is part of providing the service and is not conditional on a newsletter subscription.
14. Intellectual property
All content on the Site (text, editorial guides, design, layout, graphics, logos, illustrations and photographs, other than third-party material used under licence) is owned by or licensed to Naskio Limited and is protected by applicable intellectual property law.
You may read, print and share our content for personal, non-commercial use. You may quote short extracts provided you credit Expats Thailand and link to the original page.
You may not republish our content in whole or in substantial part, reproduce it on another website or in another publication, use it to train a machine learning model, or use it for any commercial purpose, without our prior written permission. If you would like to reuse something, ask us at contact@expats-thailand.com: we are generally happy to say yes.
15. Acceptable use
You agree not to use the Site to: submit false, misleading or fraudulent information; impersonate another person or submit someone else's data without their authority; attempt to gain unauthorised access to the Site, its servers or any connected system; introduce malware or otherwise interfere with the Site's operation; scrape or systematically extract content; send unsolicited commercial messages to us or to our Partners; or act unlawfully, abusively or in a way that harms our team, our Partners or other users.
We may refuse or discontinue service, and restrict access to the Site, where these rules are breached.
16. Availability of the Site
We aim to keep the Site available and working properly, but we do not guarantee uninterrupted access. The Site may be unavailable during maintenance, or as a result of hosting, network or third-party failures outside our control. We may change, suspend or withdraw any part of the Site at any time without notice.
17. Limitation of liability
Nothing in these Terms excludes or limits our liability for fraud, for fraudulent misrepresentation, for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded or limited.
Subject to that, and to the maximum extent permitted by applicable law:
- We are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, loss of opportunity, loss of data, or wasted expenditure, arising from your use of the Site or our services.
- We are not liable for the acts, omissions, delays, errors, negligence, insolvency or service failures of any Partner or other third party, including where we made the introduction.
- We are not liable for decisions taken by any government body, embassy, consulate, immigration office, bank, insurer or school, or for changes in law, regulation or administrative practice.
- Our total aggregate liability for any claim arising from Our Services is limited to the amount you actually paid us for the specific service giving rise to the claim.
Depending on where you live, mandatory consumer protection rules may give you rights that these Terms cannot override. Nothing here is intended to affect those rights.
18. Indemnity
You agree to indemnify us against any claim, loss or reasonable cost we incur as a result of your breach of these Terms, your submission of inaccurate or unauthorised information, or your unlawful use of the Site or our services.
19. Events outside our control
We are not liable for failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including natural disasters, flooding, epidemics, civil unrest, strikes, war, changes in law or government policy, the closure or suspension of a government service, failures of telecommunications or internet infrastructure, or the failure of a Partner for reasons beyond our control.
20. Complaints and dispute resolution
If something goes wrong, tell us. Write to contact@expats-thailand.com setting out what happened and what you would like us to do about it. We will acknowledge your message within five business days and give you a substantive answer as quickly as we reasonably can.
Where your complaint concerns a Partner, we will raise it with them on your behalf and help you pursue it, while being clear that the contractual relationship is between you and them.
We will always try to resolve a dispute directly and in good faith before either side takes it further.
21. General
Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force.
No waiver. If we do not enforce a right under these Terms on one occasion, that is not a waiver of that right.
Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours to an affiliate or to a successor of our business, provided your rights are not reduced.
Entire agreement. These Terms, together with any written confirmation of scope and price for a specific service, constitute the entire agreement between us regarding your use of the Site and Our Services.
Changes. We may update these Terms from time to time. The "last updated" date at the top of this page reflects the most recent revision. Material changes will apply to requests made after the change; continued use of the Site after a change constitutes acceptance of the updated Terms.
Language. These Terms are published in English and French. In the event of any discrepancy, the English version prevails.
22. Governing law, jurisdiction and contact
These Terms, and any dispute or claim arising out of or in connection with them, their subject matter or their formation, are governed by the laws of Hong Kong, without regard to its conflict of law principles. Any such dispute is subject to the non-exclusive jurisdiction of the courts of Hong Kong.
This choice of law does not deprive you of the protection of any mandatory consumer-protection provisions of the law of the country in which you are habitually resident, where those provisions cannot be excluded by agreement.
Questions about these Terms can be sent to contact@expats-thailand.com, or by post to Naskio Limited, Unit B, 11/F, Yam Tze Commercial Building, 23 Thomson Road, Wan Chai, Hong Kong.
